Crushing Injuries

Workplace accidents that cause crushing injuries occur in many ways. A construction worker can suffer a crushing injury if his hand is caught in a piece of machinery or a motorized vehicle runs over his foot. A falling load that strikes a warehouse worker or laborer can cause a head crushing injury or musculoskeletal crushing injury. A crushing injury may cause nerve damage, permanent numbness or deformity of a body part, or require amputation of a mangled body part.

If you or a loved one has suffered a crushing injury as a result of employment, you should talk to an experienced Massachusetts workers’ compensation attorney about the benefits you are entitled to receive. What Jobs Cause Crushing Injuries in the Workplace?

There are as many types of crushing injuries as there are different occupations involving handling heavy loads and working around heavy equipment and machinery. Massachusetts’ Department of Industrial Accidents has a list of amounts of compensation that injured workers receive when they have a hand, foot or leg crushed in a workplace accident. Yet disputes often arise between injured employers and insurance companies about the extent of the injuries, cost of medical treatment or degree of incapacity.

Workers who work around forklifts, which are also known as powered industrial trucks, may suffer crushing injuries to their torso, chest, feet, hands or head. Operators of heavy equipment such as bulldozers and front-end loaders may suffer a crushing injury if the equipment overturns on a steep slope or falls off a jack stand.

Mechanics may suffer a crushing injury if caught between the arm of a hydraulic lift and the ground when the hydraulic lift fails or is lowered unexpectedly. Mechanics may experience a crushing injury if a jack stand overturns, allowing a vehicle to fall.

Warehouse workers may suffer a workplace crushing injury if struck by falling pallets or heavy materials. Shippers and warehouse workers may be crushed between a tractor-trailer and a loading dock.

Crane riggers and construction workers who assist crane operators in transferring loads such as pipe, steel beams or building materials may be crushed by a dropped load if they stand in the fall zone.

Workers who load, unload and handle large heavy granite slabs and stone slabs are at risk of a crushing injury, including fatal crushing injuries. Stone slabs can weigh hundreds to thousands of pounds. Several fatal workplace injuries were reported in Massachusetts and Rhode Island involving workers who were crushed between stone slabs weighing from 4,000 to 6,000 pounds.

Farm workers who handle large animals may suffer workplace injuries, including crushing injuries, if they get pinned between the animal and a gate, fence or wall.

What Workers’ Compensation Disability Benefits Are Available?

A crushing injury can incapacitate a worker temporarily or leave him or her permanently unable to return to a former job. You may be eligible for temporary total disability, partial disability or permanent and total disability benefits as a result of a crushing injury. Employee’s workers’ compensation benefits are determined by several factors, including average weekly wage and degree of incapacity from a workplace injury. A knowledgeable Massachusetts workers’ compensation attorney can review your workplace injury and advise you about which benefits you are entitled to collect.
