The Workers’ Compensation System in Boston, Massachusetts

The Department of Industrial Accidents (DIA) is responsible for overseeing the workers’ compensation system in Massachusetts. The DIA’s primary responsibility is to act as a court system to resolve disputed workers’ compensation claims. The Office of Claims Administration (OCA) serves as the “starting point” in the DIA for Boston workers who have a work-related injury or illness.
You must tell your employer right away if you are injured at work even if it does not seem serious at the time. If you have a work-related injury or illness which results in lost work time of five full or partial calendar days or more, your employer must file the Employer’s First Report of Injury or Fatality (also called Form 101) with the DIA and their workers’ compensation insurance company within seven calendar days. The insurance company then has 14 calendar days from receipt of this form to investigate the claim and make a decision as to whether to pay your workers’ comp claim.
