The Workers’ Compensation System in Massachusetts
If you are injured or become sick because of your work In Massachusetts, you have a right to medical treatment. In some cases, wage replacement benefits are also available under our state’s workers’ compensation law.
The Department of Industrial Accidents (DIA) is responsible for overseeing the workers’ compensation system in Massachusetts. There are DIA offices in Boston, Fall River, Lawrence, Springfield, and Worcester. The DIA’s primary responsibility is to act as a court system to resolve disputed workers’ comp claims. The Office of Claims Administration (OCA) is the “starting point” in the DIA for Massachusetts workers who have a work-related injury or illness.
You must tell your employer right away if you are injured at work, even if it does not seem serious at the time. If you have a work-related injury or illness that results in lost work-time of five full or partial calendar days or more, your employer must file the Employer’s First Report of Injury or Fatality (Form 101) with the DIA and their workers’ compensation insurance company within seven calendar days. The insurance company then has 14 calendar days from receipt of this form to investigate the claim and make a decision as to whether to pay your workers’ compensation claim.
